Trademark is one of the intellectual property rights with a distinguishing sign, design or expression which is easily recognisable and helps the product of a particular company stand out from the rest in the market. Trademark may be in the form of a brand name, logo, product name, symbols, slogans or even a combination of them.

Why do you need trademark registration?
Apart from giving a unique identity to the company’s product, a trademark also restricts a third person from copying or infringing on someone else’s work. It also encourages companies to meet the expectation of its customers and adhere to its standards on a consistent basis. Improper use of a trademark can also render the person doing so liable to legal actions instigated against him by the owner of the trademark.
Documents required for trademark registration:
- Business Registration proof
- Identity proof and Address proof of business
- Identity proof and Address proof of its directors
- Soft copy of the trademark selected
- The proof of claim of the proposed mark that it can be used in another country
- Power of attorney to be signed by the applicant
Process for Trademark Registration:
Step 1: TRADEMARK SEARCH
The very first step towards trademark registration is to first doing a thorough trademark search just to make sure that the trademark you wish to register is unique in all respects.
Step 2: APPLYING FOR TRADEMARK
Once you are satisfied that no similar trademarks is registered previously with the Trademark Registry of India, you have to make an application to get the same registered. This can be done online and a receipt is generated for future reference.
Step 3: EXAMINATION OF DOCUMENTS
After you have filed the application, it is examined by the examiner and if found fit, the trademark is published in the Trademark Journal.
Step 4: PUBLICATION
After the examination of application, the trademark is provisionally published in the Trademark Journal so that any person who may object the same will have sufficient time of 3-4 months to raise objections.
Step 5: CERTIFICATE OF REGISTRATION
A Certificate of Registration is issued by the Trademark Office to the applicant.
Step 6: RENEWAL OF TRADEMARK
Once a trademark gets registered, it is valid for a period of 10 years. Hence, after the expiry of 10 years, one should get the trademark renewed.
